Terms of service

Last updated: {last updated}

1. Acceptance of these terms

These terms govern your access to and use of the TuneForge tuning fileservice operated by {legal entity name}, {registered address} (“we”, “us”). By creating an account or using the service, you agree to these terms. If you are using the service on behalf of a business, you confirm you are authorised to bind that business.

2. Accounts

You are responsible for keeping your account credentials secure and for all activity under your account, including the actions of team members you invite. Tell us promptly if you suspect unauthorised use. We may suspend or close accounts that breach these terms.

3. Credits & payment

The service is paid for using credits or per-file payments. Prices are shown ex-VAT in euros and may change over time; the price applicable to an order is the one shown at the time you confirm it. Payments are processed by our payment provider, and applicable taxes are added at checkout. Credits represent a prepaid balance for services and are not a stored-value or e-money product.

4. Acceptable use

You agree to use the service only for lawful purposes and only for vehicles and files you are authorised to work on. You must not upload malicious content, attempt to disrupt the service, or use it to infringe the rights of others. We may remove content or restrict access where we reasonably believe these terms have been breached.

5. Files & road-legality responsibility

We produce modified ECU files based on the original reads and configuration you provide. You are responsible for verifying that any modification is permitted for the vehicle and its intended use, and for compliance with applicable road-traffic, emissions and type-approval laws in your jurisdiction. Many modifications are intended for closed-course or off-road use only. Reference power and torque figures shown in the service are expected references from tuning data, not a per-vehicle guarantee. You are responsible for correctly flashing files to the vehicle.

6. Limitation of liability

To the fullest extent permitted by law, the service is provided “as is” and we are not liable for indirect or consequential loss, loss of profit, or damage to vehicles or components arising from the use or misuse of files, including incorrect flashing or use on incompatible hardware. Nothing in these terms limits liability that cannot be limited by law. {insert any liability cap to be confirmed by counsel}

7. Governing law

These terms are governed by the laws of {governing jurisdiction}, and the courts of {competent courts} have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protections that may apply.

8. Changes & contact

We may update these terms; material changes will be communicated through the service. Questions about these terms can be sent to {legal contact email}.
